Ms. Silva has requested and obtained pest control services from Kraus Management, the building management company, however, the fumigations have proven to be ineffective.

Ms. Silva, who suffers from asthma and multiple sclerosis, faces the additional challenge of mold in her apartment. This poses a serious health risk for her, especially considering her medical conditions. Her husband, Rafael Silva, takes care of her. Despite their efforts to make ends meet, the presence of mold creates an unhealthy living environment for their three daughters. Their youngest daughter, AmirahRose, also has asthma like her mother.

In early 2023, AmirahRose fell ill with symptoms of pneumonia and had to be placed in an induced coma for a week in February. During this time, one of her lungs completely collapsed while the other partially collapsed. Thankfully, she eventually recovered.

The problems extend beyond the apartment itself, as the overall quality of life in the building is also concerning. At one point, the building’s door could be easily opened with a MetroCard, compromising security. The hallways are frequently filled with cigarette smoke, unfamiliar individuals, and the unpleasant odor of urine. Additionally, the washing machines rarely function properly, and there are instances where the coin boxes have been tampered with to steal money.
